Terms of Service

Effective from 28. 9. 2026

These terms of service govern the rights and obligations of the seller and the buyer when goods are pre-ordered through the website https://tmvr.cz. Matters not covered by them are governed by Czech Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.

1. Seller and buyer

The seller is David Lipowski, company ID: 14241978, registered at Tišnovská 1382/4, 61400, Brno (the “seller”). Contact e-mail: spravce@tmvr.cz.

The buyer is a consumer or a business that sends a pre-order through the form on the website (the “buyer”). Consumer protection provisions apply only to buyers who are consumers.

2. Goods and price

The seller offers a limited series of T-shirts as a pre-sale. The description of the goods, the available sizes and the price are shown on the website next to the pre-order form.

Prices are in Czech crowns (CZK) and are final. Prices in euros are informative only and serve foreign buyers; payment is always made in CZK.

The price of the chosen delivery method, shown in the form before the pre-order is sent, is added to the price of the goods. The seller charges no other fees.

3. Pre-order and conclusion of the contract

The buyer sends a pre-order by filling in the form and pressing the “Reserve now” button, which creates an obligation to pay. Before sending, the buyer can check and correct the data in the form.

After sending, the buyer receives an e-mail and an SMS with a summary of the pre-order, the payment details and a private link to its details. This message only confirms that the pre-order has been received.

The purchase contract is concluded when the seller separately confirms the pre-order to the buyer, usually after the payment has been received. The seller may refuse a pre-order, in particular if the limited series is sold out; in that case any payment already received is refunded without undue delay.

The contract is concluded in Czech or English according to the chosen version of the website. The seller archives the contract electronically and the buyer can access its summary through the link to the pre-order details.

The costs of distance communication (internet, telephone) are borne by the buyer and do not differ from standard rates.

4. Payment

The buyer pays the price by bank transfer to the seller’s account shown in the pre-order summary, using the pre-order number as the variable symbol (payment reference). The QR code can be used for the payment.

The price must be paid by the end of the pre-sale shown on the website. If the price is not paid, the seller does not confirm the pre-order and no contract is concluded.

The seller issues a proof of payment and sends it to the buyer electronically.

5. Delivery of goods

The goods are produced after the pre-sale ends. The expected dispatch date is shown on the website and in the pre-order summary. If the seller does not deliver the goods even within an additional reasonable period granted by the buyer, the buyer may withdraw from the contract.

For delivery to an address, the seller sends the goods by a carrier to the address entered in the form. For personal pickup, the seller and the buyer agree on the place and time of handover (at an event or in Brno) by e-mail or telephone.

The risk of damage to the goods passes to the buyer upon receipt. We recommend checking the parcel on receipt and reporting any damage to the packaging to the carrier immediately.

6. Right of withdrawal

A buyer who is a consumer has the right under Section 1829 of the Civil Code to withdraw from the contract without giving any reason within 14 days from the day the goods are received. The buyer may also withdraw before receiving the goods.

The withdrawal must be communicated to the seller by an unambiguous statement, for example by e-mail to spravce@tmvr.cz. The deadline is met if the statement is sent before it expires. The buyer may use the model form below, but it is not obligatory.

The buyer returns the goods to the seller within 14 days of the withdrawal. The direct cost of returning the goods is borne by the buyer.

The seller refunds all payments received, including the cost of the cheapest delivery method offered, within 14 days of the withdrawal by bank transfer. The seller may withhold the refund until the goods have been returned or the buyer has proved that they were sent back.

The buyer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature and characteristics (for example wearing or washing them).

Model form: “I hereby give notice that I withdraw from the contract for the purchase of the following goods: … Pre-order number: … Date received: … Name: … Address: … E-mail: … Bank account for the refund: … Date and signature (paper version only).”

7. Rights from defective performance (complaints)

The seller is liable to the buyer for the goods being free of defects on receipt (Section 2161 et seq. of the Civil Code). A consumer may report a defect within 24 months of receiving the goods.

The buyer may request that the defect be removed by repair or by replacement with goods free of defects. If this is not possible, or the seller refuses to remove the defect or does not remove it in time, the buyer may request a reasonable discount or withdraw from the contract.

The buyer reports a defect by e-mail to spravce@tmvr.cz with the pre-order number, a description of the defect and ideally a photo. The seller confirms receipt of the complaint, decides how it will be handled and settles it without undue delay, at the latest within 30 days of its submission unless a longer period is agreed with the buyer.

Normal wear and tear and damage caused by improper handling, for example washing contrary to the care label, are not defects.

8. Out-of-court dispute resolution and supervision

The Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, www.coi.cz, is competent for the out-of-court resolution of consumer disputes arising from the contract. A proposal can be submitted within 1 year of the day the buyer first exercised the right with the seller.

Compliance with consumer protection obligations is supervised by the Czech Trade Inspection Authority, personal data protection by the Office for Personal Data Protection, and the seller’s business by the competent trade licensing office.

9. Personal data

The processing of buyers’ personal data is described in the Privacy Policy at https://tmvr.cz/privacy.php.

10. Final provisions

The contract and these terms are governed by the law of the Czech Republic. If the buyer is a consumer habitually resident in another EU member state, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of that state.

The seller may change these terms. A pre-order is governed by the version in effect when it was sent.

These terms of service are effective from 28. 9. 2026.
